Ted Neitzke: The transparency commitment and the later records ruling

Promise vs outcome

Statement: Last updated:

Exact statement

“We will prioritize accountability and transparency every step of the way.” [1]

Ted Neitzke, Official letter from Mayor Neitzke to City of Port Washington residents, January 8, 2025

Neitzke made the commitment while presenting a potential data-center project and explaining the conditions under which the City would pursue an agreement.[2][3]

What the record shows

Wisconsin CCAP identifies the matter as Ozaukee County case 2025CV000521, Lynde Uihlein v. City of Port Washington, a petition for writ of mandamus assigned to Judge Adam Gerol.[4][5] At the January 28, 2026 motion hearing, Gerol denied the City's motion to quash and dismiss; the reported basis was that the City's response was incomplete because the requested communications included their email attachments.[6][7][8]

“There has not been a complete response to the open records request. For that reason alone, the motion (to dismiss the case) is not properly supported.” [8]

Judge rejects city request to dismiss records lawsuit, January 28, 2026

Context

The dispute concerned whether a request for communications included email attachments that the City had not produced.[9][10] Gerol said the emails and attachments had to be viewed together as the complete communication.[7] Gerol did not issue the requested writ at that hearing; the court record says a factual record was still required and that another hearing was set.[11][12] As of October 10, 2026, the court record lists the case as open, with a hearing scheduled for October 15, 2026.[13][14]

Analysis

The January 2025 statement promised accountability and transparency “every step of the way.”[15] At the January 28, 2026 hearing in the records case, the court denied the City's motion to quash and dismiss after finding the response incomplete because attachments were part of the requested communications.[16][17][8] The contrast is institutional rather than proof that Neitzke personally handled the request; Wisconsin Watch reported that he said he was not part of the records-release process.[18] The January 28 ruling also did not resolve whether a writ should issue or whether the City had ultimately complied, because Gerol said a factual record was required and set another hearing.[19][11]
