Ted Neitzke: The resident-convenience statement and the later construction-hour limits

Promise vs outcome

Statement: Last updated:

Exact statement

“Although construction would be limited to a specific area and only temporary, it is still a factor to consider. This will be done with the convenience of residents in mind.” [1]

Ted Neitzke, Office of the Mayor letter, Proposed Data Center – Pros and Cons, February 18, 2025

Neitzke listed construction disruption among the project’s potential drawbacks and said the list was preliminary and could change as the City’s investigation continued.[2][3] The statement acknowledged that construction would be disruptive, but said it would be conducted with residents’ convenience in mind.[4]

What the record shows

After residents reported overnight noise and light disruption, the Plan Commission unanimously restricted outdoor construction hours and nighttime lighting; Neitzke said the overnight work had become too disruptive and needed to end.[5][6][7][8][9]

“In response, the Port Washington Plan Commission on Thursday unanimously passed an amendment to the building, site and operations plan for the development. The amendment limits outdoor construction to between 6 a.m. and 8 p.m. Monday through Saturday. Lighting also has to be ‘reduced to security levels’ after 8:30 p.m.” [10]

Context

Wisconsin Public Radio reported the Commission’s March 19 amendment and the City’s April 18 implementation date.[11][12][13] The same report quoted Neitzke saying 24-hour construction had always been temporary and was intended to enclose the buildings quickly, but that residents’ reported inconvenience outweighed the scheduling benefit.[14][15] Indoor work could still continue for extended hours once buildings were fully enclosed.[16]

Analysis

The February statement was not a promise of no disruption; it expressly recognized temporary construction impacts.[17] It did, however, state that the work would be carried out with residents’ convenience in mind.[18] The later unanimous hours amendment, resident accounts of round-the-clock noise and light, and Neitzke’s own conclusion that overnight work was too disruptive document an outcome that materially undercut that assurance.[19][8][5][20] The City subsequently changed the rules in response, so the record supports a promise-versus-outcome comparison without implying that all construction disregarded residents or that the disruption was permanent.[21][22]
