Ted Neitzke: The infrastructure-cost statement and the later agreement

Promise vs outcome

Statement: Last updated:

Exact statement

“Zero predevelopment and infrastructure costs for the City. Costs would be borne by the company that builds and operates a data center.” [1]

Ted Neitzke, Office of the Mayor letter, Proposed Data Center – Pros and Cons, February 18, 2025

Neitzke presented a preliminary list of potential benefits and drawbacks while the City was evaluating the proposed data center.[2] He expressly cautioned that the list could change as the investigation continued.[3]

What the record shows

The executed agreement provides for the City to reimburse qualifying development costs from project tax increment, with those costs accruing seven percent annual interest until reimbursed.[4][5]

“"Developer Reimbursements" means the reimbursements for costs that the City will pay to Developer solely from Tax Increment. A list of those Development Costs which qualify as Developer Reimbursements is attached hereto as EXHIBIT C. The Development Costs which qualify as Developer Reimbursements shall accrue interest at a rate of seven percent (7%) per annum from the date incurred until the date received by Developer;” [6]

Development Agreement Between the City of Port Washington and Vantage Data Centers Management Company, LLC, August 19, 2025

Context

The City and Vantage entered into the agreement on August 19, 2025, after the February 18 letter.[7][8] Exhibit C identifies public-improvement design, construction and installation, Knellsville water and sewer extensions, and project electrical infrastructure among reimbursable costs.[9][10][11] Annual reimbursement payments are subject to Common Council appropriation and are not a general obligation of the City.[12]

Analysis

The February statement projected that the company would bear the City’s predevelopment and infrastructure costs, within a list expressly described as preliminary.[1][3] The executed agreement later made specified public-improvement and electrical-infrastructure costs eligible for City reimbursement from project tax increment with seven percent interest.[6][13][11] Those reimbursement payments are subject to Common Council appropriation and are not a general obligation of the City.[12] That documented financing outcome differs materially from the stated zero-cost result while retaining the agreement’s limits.[1][4][12]
